Abstract

"The spread of hatred and hate speech has intensified in many corners of the world over the last decade and its regulation presents a conundrum for many democracies. This book presents a three-prong theory describing three different but complementary models of hate speech regulation which allows stakeholders to better address this phenomenon. It examines international and national legal frameworks and related case law as well as pertinent scholarly literature review to highlight this development. After a period of an absence of free speech during communism, post-communist democracies have sought to build a framework for the exercise of free speech while protecting public goods such as liberty, equality and human dignity. The three-prong theory is applied to identify public goods and values underlining the regulation of hate speech in the Czech Republic and Slovakia, two countries that share a political, sociological, and legal history, as an example of the differing approaches to hate speech regulation in post-communist societies due to divergent social values, despite identical legal frameworks"

Abstract

Wie muss der Staat Opferschutz im Migrationsrecht gestalten? Um rechtsdogmatische Fragestellungen zum Aufenthaltsrecht Betroffener von Hasskriminalität zu beantworten, bedient sich die vorliegende Untersuchung auch sozialwissenschaftlicher und viktimologischer Erkenntnisse. Der hybriden Rechtsmaterie wird durch die Analyse europa- und völkerrechtlicher Vorgaben sowie des deutschen Verfassungs-, Verwaltungs- und Straf(verfahrens)rechts Rechnung getragen. Darüber hinaus wird die Verwaltungspraxis in der Bundesrepublik empirisch untersucht. Deutlich wird der Bedarf einer Reform zur Klarstellung der aufenthaltsrechtlichen Position für Betroffene von Hasskriminalität. Die Arbeit schließt mit entsprechenden Gesetzesvorschlägen.

The book is anchored by Sternberg's FLOTSAM theory, which identifies key conditions that enable the development and transmission of hate, including fear, license, obedience to authority, trust, sense of belonging to a valued group, amplification of arousal, and modeling. Chapters work through various manifestations of hate: hate as a thought, a feeling, or an action; forms of hate that are rooted in group bias, or that stem from a single relationship; and hate that varies in intensity, from the mundane to the extreme. Authors also explore the various cognitive and emotional processes at work, as well as the political motivations that can spark violent acts of hate.
